1. ELIGIBILITY/SPONSOR.
The Sweepstakes is sponsored by Rockbridge Associates, Inc., a Virginia corporation with an address at 10130 G Colvin Run Road, Great Falls, VA 22066 (“Sponsor”). Officers, directors, employees, and other agents of Sponsor or any of Sponsor’s parents, subsidiaries, affiliated companies, distributors, and advertising, promotional, or judging agencies, together with all persons engaged in the development, production, or distribution of materials for this Sweepstakes (collectively, “Promotion Parties”), including their immediate family members (parent, child, sibling, and spouse of each) and/or persons living in their households (whether related or not), are not eligible to enter.
2. HOW TO ENTER.
There are two ways to enter the Sweepstakes, as described in subsections (a) and (b) below. No purchase is necessary. It is not necessary to use the Primary Means of Entry (as described below) to enter or win the Sweepstakes. Using the Primary Means of Entry does not increase your chance of winning. THERE IS A
LIMIT OF ONE SWEEPSTAKES ENTRY PER PERSON, REGARDLESS OF ENTRY METHOD.
(a) Primary Means of Entry. Upon completion of the ACMA Workforce Development Survey during the Promotion Period, you will be automatically entered to win.
(b) Alternative Means of Entry. To enter without completing the Primary Means of Entry, please print your name, full mailing address, telephone number, and email address on a 3 x 5 inch (or 7.5 x 12.5 cm) piece of paper and mail it to Attn: Michael Schwartz, 10130 G Colvin Run Road, Great Falls, VA 22066. Each mail-in entry must be in a separate postmarked envelope. Sponsor is not responsible for lost, late, illegible, misdirected, mutilated, incomplete, or postage-due mail-in entries. Mail-in entries must be postmarked by October 9th 2023, and must be received by October 23rd, 2023.
3. PRIZE.
Five (5) winners will each be awarded individual prizes of $100 Starbucks gift cards each. You acknowledge and agree that Promotion Parties have not made, neither are they in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize or any
aspect of any prize.
4. ODDS OF WINNING.
The odds of winning depend upon the number of eligible entries received.
5. GENERAL TERMS.
No substitution of any prize is offered, and no transfer of a prize to a third party is permitted. Prize winners will be solely responsible for all applicable federal, state, and local taxes on prize. Winners who are U.S. residents may receive an IRS Form 1099 from Sponsor for the retail value of the prize. All other expenses on the receipt and use of the prizes not specifically mentioned herein are solely the responsibility of the winner. All entrants, as a condition of entry in the Sweepstakes, agree to be bound by these Official Rules, which are final and binding in all respects. 6. WINNER NOTIFICATION.
On or about October 23rd, 2023, a random drawing will be conducted by Sponsor’s designee to select the winners from all eligible entries received. Winners will be notified by email. If a winner is found to be ineligible or not in compliance with these Official Rules, or if prize notification or any prize is returned as undeliverable, the prize may be forfeited. Winners may be required to complete and sign any releases that Sponsor deems necessary. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner.
7. CONDITIONS.
Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual from participating in any aspect of Sweepstakes if Sponsor and/or its administrators deem or suspect that such person has engaged in or has attempted to engage in any of the following: (a) acting in violation of these Official Rules or the terms and conditions of a Sponsor website; (b) damaging, tampering with, or corrupting the operation of the Sweepstakes; (c) acting with intent to annoy, harass, or abuse any other person; (d) use of any automated bot, script, or other robotic, mechanical, programmed, or automated devices to submit data through online means; (e) any unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (f) any activity deemed in the sole discretion of Sponsor and its administrators to be generally inconsistent with the intended operation of the Sweepstakes. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly, even if the disqualified potential winner’s name may have been publicly announced.
ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR CORRUPT ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR EVENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS ADMINISTRATORS RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT OR ANY OTHER PROVISION.
8. WINNERS LIST.
For the names of the prize winners, mail a self-addressed stamped envelope to: Attn: Michael Schwartz, 10130 G Colvin Run Road, Great Falls, VA 22066. Requests must be received no later than December 8th, 2023.
9. RELEASE.
Acceptance of a prize constitutes a winner’s permission for the Promotion Parties to use the winner’s name, photograph, likeness, voice, biographical information, statements, and address (city and state) for advertising and/or publicity purposes worldwide in all forms of media now known or hereafter developed, in perpetuity, without further compensation, except where prohibited by law. By participating in the Sweepstakes, each participant (or their parent or legal guardian if an eligible minor) agrees (and agrees to confirm in writing) to release and hold Sponsor and its employees, officers, directors, shareholders, agents, representatives, parent company, affiliates, subsidiaries, legal advisors, and advertising, promotion, and
fulfillment agencies harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
10. LIMITATIONS OF LIABILITY.
(A) NO RESPONSIBILITY OR LIABILITY IS ASSUMED BY THE SPONSOR OR PROMOTION PARTIES FOR TECHNICAL PROBLEMS OR TECHNICAL MALFUNCTION ARISING IN CONNECTION WITH ANY OF THE FOLLOWING OCCURRENCES: (I) HARDWARE OR SOFTWARE ERRORS; (II) FAULTY
COMPUTER, TELEPHONE, CABLE, SATELLITE, NETWORK, ELECTRONIC, WIRELESS, OR INTERNET CONNECTIVITY OR OTHER ONLINE OR OTHER COMMUNICATION PROBLEMS; (III) ERRORS OR LIMITATIONS OF ANY INTERNET SERVICE PROVIDERS, SERVERS, HOSTS OR PROVIDERS; (IV) GARBLED, JUMBLED, OR FAULTY DATA TRANSMISSIONS; (V) FAILURE OF ANY EMAIL TRANSMISSIONS TO BE SENT OR RECEIVED; (VI) LOST, LATE, DELAYED, OR INTERCEPTED EMAIL TRANSMISSIONS; (VII) LOST, LATE, ILLEGIBLE, MISDIRECTED, MUTILATED, INCOMPLETE, OR POSTAGE-DUE MAIL; (VIII) INACCESSIBILITY OF A SPONSOR WEBSITE IN WHOLE OR IN PART FOR ANY REASON; (IX) TRAFFIC CONGESTION ON THE INTERNET OR A
SPONSOR WEBSITE; (X) UNAUTHORIZED HUMAN OR NON-HUMAN INTERVENTION OF THE OPERATION OF THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION UNAUTHORIZED TAMPERING, HACKING, THEFT, VIRUS, BUGS, OR WORMS; OR (XI) DESTRUCTION OF ANY ASPECT OF THE SWEEPSTAKES, OR LOSS, MISCOUNT, MISDIRECTION, INACCESSIBILITY, OR
UNAVAILABILITY OF ANY SPONSOR WEBSITE USED IN CONNECTION WITH THE SWEEPSTAKES.
(B) SPONSOR AND PROMOTION PARTIES ARE NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR PRINTING ERRORS IN ANY DISPLAY OR ANNOUNCEMENT OF PRIZES, MATERIALS ASSOCIATED WITH THE SWEEPSTAKES, OR THESE OFFICIAL RULES, OR ANY INACCURATE OR INCORRECT DATA CONTAINED ON A SPONSOR WEBSITE, INCLUDING WITHOUT LIMITATION THE NUMBER OF ENTRIES SUBMITTED IN THIS SWEEPSTAKES OR ANY PERSONAL INJURY OR PROPERTY DAMAGE OR LOSSES OF ANY KIND WHICH MAY BE SUSTAINED TO COMPUTER EQUIPMENT OR MOBILE PHONE EQUIPMENT RESULTING FROM ANY USE OF A SPONSOR WEBSITE.
(C) SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CANCEL OR SUSPEND THIS SWEEPSTAKES SHOULD FRAUD, VIRUS, BUGS, OR OTHER CAUSES BEYOND THE CONTROL OF SPONSOR CORRUPT THE ADMINISTRATION, SECURITY, OR PROPER ADMINISTRATION OF THE
SWEEPSTAKES. IN THE EVENT OF CANCELLATION, SPONSOR WILL RANDOMLY AWARD THE PRIZES FROM AMONG ALL ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED PRIOR TO CANCELLATION.
(D) SHOULD MULTIPLE USERS OF THE SAME EMAIL ACCOUNT ENTER THE SWEEPSTAKES AND A DISPUTE THEREAFTER ARISE REGARDING THE IDENTITY OF THE ENTRANT, THE AUTHORIZED ACCOUNT HOLDER OF SAID EMAIL ACCOUNT AT THE TIME OF ENTRY WILL BE CONSIDERED THE
ENTRANT. “AUTHORIZED ACCOUNT HOLDER” IS DEFINED AS THE NATURAL PERSON WHO IS ASSIGNED AN EMAIL ADDRESS BY AN INTERNET ACCESS PROVIDER, ON-LINE SERVICE PROVIDER, OR OTHER ORGANIZATION WHICH IS RESPONSIBLE FOR ASSIGNING EMAIL ADDRESSES OR THE DOMAIN ASSOCIATED WITH THE SUBMITTED EMAIL ADDRESS.
(E) WITHOUT LIMITING THE FOREGOING, EVERYTHING ON A SPONSOR WEBSITE IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT.
11. CLASS ACTION WAIVER.
NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. NEITHER SPONSOR NOR ENTRANT MAY CONSOLIDATE MORE THAN ONE INDIVIDUAL’S CLAIMS, AND EACH EXPRESSLY WAIVES ANY RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION.
12. ARBITRATION.
THIS SWEEPSTAKES SHALL BE GOVERNED BY AND INTERPRETED UNDER THE LAWS OF THE STATE OF VIRGINIA, U.S.A., WITHOUT REGARD TO ITS CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE THAT ANY AND ALL DISPUTES, CLAIMS, CAUSES OF ACTION, OR CONTROVERSIES (“CLAIMS”) ARISING OUT OF OR IN CONNECTION WITH THIS SWEEPSTAKES SHALL BE RESOLVED BY ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION BY ONE OR MORE ARBITRATORS APPOINTED IN ACCORDANCE WITH SAID RULES. SUCH ARBITRATION SHALL TAKE PLACE IN THE CITY OF WASHINGTON, D.C., U.S.A. THE ARBITRATOR’S AUTHORITY TO RESOLVE CLAIMS IS LIMITED TO CLAIMS BETWEEN SPONSOR AND ENTRANT ALONE, AND THE ARBITRATOR’S AUTHORITY TO MAKE AWARDS IS LIMITED TO AWARDS TO SPONSOR AND ENTRANT ALONE. FURTHERMORE, CLAIMS BROUGHT BY EITHER PARTY AGAINST THE OTHER MAY NOT BE JOINED OR CONSOLIDATED IN ARBITRATION WITH CLAIMS BROUGHT BY OR AGAINST ANY THIRD PARTY, UNLESS AGREED TO IN WRITING BY ALL PARTIES. NO ARBITRATION AWARD OR DECISION WILL HAVE ANY PRECLUSIVE EFFECT AS TO ISSUES OR CLAIMS IN ANY DISPUTE WITH ANYONE WHO IS NOT A NAMED PARTY TO THE ARBITRATION.
NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE A CLAIM IN COURT OR HAVE A JURY TRIAL. NOTE THAT OTHER RIGHTS YOU WOULD HAVE IF YOU WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. ANY CLAIMS, JUDGMENTS, AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. NOTWITHSTANDING ANY OTHER PROVISION IN THESE OFFICIAL RULES AND WITHOUT WAIVING EITHER PARTY’S RIGHT TO APPEAL SUCH DECISION, SHOULD ANY PORTION OF THIS PROVISION BE DEEMED INVALID OR UNENFORCEABLE, THEN THE ENTIRE PROVISION (OTHER THAN THIS SENTENCE) SHALL NOT APPLY.
